Terms of service

Spinery is offered by Davide Caricati ("we"). To use Spinery you must accept these Terms: the app asks you at your first sign-in and, when they change substantially, again at your next sign-in. Without accepting them the app cannot be used. There are two checkboxes: one to accept the Terms, the other to specifically approve, as articles 1341 and 1342 of the Italian Civil Code require, clauses 5 (a free service, as is), 6 (your data and your copies), 8 (limitation of liability), 9 (changes and closure of the service) and 10 (the content you upload).

1. The service

Spinery is a service for keeping your record collection — vinyl, CDs, cassettes — and sharing it with the people you invite into your circle. It is free.

The artificial-intelligence features are the heart of the service: the Curator, which knows the collection and talks about it with you; the weekly suggestions; the monthly summary; adding from a photo; search help; the stories of records and artists. The Curator and the other artificial-intelligence features are included, within the usage limits shown in the app; beyond those limits you can use a key of an external provider that you choose and pay for: in that case their costs and terms are the provider's. With the included features the provider is Anthropic. The Curator says it is an artificial intelligence, talks only about music, can be wrong and changes nothing in the collection on its own: every change it proposes becomes real only if you confirm it. Its safety rules apply to everyone and take into account that Spinery is also used by teenagers from the age of 14.

Artificial intelligence is part of the service: by using Spinery you accept that the AI features process data as described in the privacy notice.

2. Your account

To use Spinery you must be at least 14, or the minimum age of your country if it is higher (the privacy notice explains it). The account is personal; you are responsible for the password and for what is done with the account. You can delete it at any time from the app or from the Delete your account page. We may suspend an account that breaches these Terms or the law.

3. Your content

What you enter (notes, stories, photos, ratings) stays yours. You allow us to store it and show it to the members of your circle so that the service works. Do not upload content you have no right to use or that offends other people.

4. External sources

Record details (editions, track lists, cover art) come from Discogs, music previews from Apple and live videos from YouTube; they are subject to those services' terms and may change or be unavailable. We do not guarantee that every record exists in the sources.

5. A free service, as is

Spinery is free and is provided "as is" and "as available". We do our best to keep it working and to keep the data safe, but we do not guarantee that the service will always be available, error-free or fit for a particular purpose.

6. Your data and your copies

We make regular backups, but we cannot guarantee that data will never be lost or damaged. You are responsible for keeping a copy of it: the app lets you export it whenever you want, and we recommend doing so regularly.

7. Third-party information and AI texts

Record data, covers, previews and values come from third-party services (such as Discogs and Apple) and may be incomplete or wrong; values are only indicative. Texts written by artificial intelligence (the Curator, the suggestions, the stories) may contain errors: they are not professional advice and should be checked.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for: loss of or damage to data and content; indirect or consequential damages; interruptions or suspensions of the service; errors in third-party information or in AI texts; the use you make of the information in the service. This does not affect our liability for wilful misconduct or gross negligence, nor any right the law grants you that cannot be excluded.

9. Changes and closure of the service

We may change or discontinue features of the service, for technical, security, cost or legal reasons. If we decided to close Spinery, we would announce it in the app at least 30 days in advance, to give you time to export your data. We may update these Terms: when the changes are substantial we ask you again at sign-in, and to use Spinery you will have to accept them; other changes are announced in the app. If you do not want to accept a new version, you can still have your data (from the app or by writing to support@spinery.it) and delete your account.

10. The content you upload

Upload only content (photos, texts) you hold the rights to; if a third party holds us to account for content you uploaded in breach of their rights, you are responsible for it.

11. Law and contact

Italian law applies, together with the consumer rights the law of your country grants you. For any question write to support@spinery.it.
